Dear Parties,
The Center refers to the attached email
communications.
In case Parties would like to settle, and need some
time to finalize
the agreement and transfer/cancellation of the domain names, the request
for suspension of the Administrative Proceeding should be made by the
Complainant to the Center by email and signed original (or fax), copied
to Respondent. The Center will then confirm the suspension to the
parties in writing. Once the transfer/cancellation of the domain names
has been concluded, the proceedings will be terminated at the request of
the Complainant.
You will note that if the case is terminated before
the Panel
appointment, we shall refund to Complainant any fees paid to us, less a
USD 500 processing fee, as specified in Annex D of the WIPO Supplemental
Rules for Uniform Domain Name Dispute Resolution Policy
(http://arbiter.wipo.int/domains).
Sincerely,
Leena Ballard

Dear WIPO and Camille:
I have been in contact with the
registrant of MINNESOTAMENSA.ORG (respondent in the above-referenced case)
and he has agreed to transfer the domain name to my client, American Mensa.
I am requesting that the domain name be temporarily unlocked for the limited
purpose of allowing Mr. Heigl to change the domain name information to
American Mensa's contact information I am not sure of WIPO's protocol on
this, but I imagine that WIPO will need to authorize this before Wild West
can take this action. Hopefully this will resolve the matter.
To WIPO:
In light of these settlement talks, I would
like to request a temporary two week suspension of these roceedings pending
resolution. Please let me know if a more formal request needs to be made.
Thank you.
Best Regards,
Jason A. Aquilino, Esq.

Dear Mr. Aquilino,
Thank you for your message.
In order for us to unlock the name so that the current registrant can
transfer the domain name to your client, you will need to submit a request
to suspend the administrative proceeding through WIPO. You will need to
check with WIPO regarding the formalities of the request. WIPO will then
notify us and we will unlock the domain name during the required time period
once they have reviewed your request. They will be able to verify the time
period in which the proceeding will be suspended.
Kind Regards,
Camille
