has been transferred to an entity called "Minnesota Mensa". Kindly
indicate whether the Complainant has control over the domain name.

Dear Parties,

In his last e-mail in this case, entitled "RE: WIPO Case No. D2005-0068/
Notification of Suspension" and sent Thu, 24 Feb 2005 17:36:24 -0500,
Jason Aquilino told a partial truth, but failed to tell you the whole
truth.

In his message, he wrote "Respondent has failed to transfer the domain
name to Complainant in this case."

While this may be factually true on the face of it, Jason Aquilino lied
by omission, deliberately failing to include the material information
that Complainant never requested Respondent to transfer the domain name
to Complainant.

Instead, Complainant actually requested Respondent to transfer the name
to a third entity, Minnesota Mensa. The exact quote is "must be
transferred to Minnesota Mensa at once."

As Webmaster of Minnesota Mensa pursuant to a signed written agreement
(found at http://www.millcityrecords.com/mndensa/agreement.htm), on
February 13, 2005, Respondent did in fact transfer the domain name to
Minnesota Mensa as requested by Complainant.


In addition, please also note and file the following two points for
future reference:

1. In the same e-mail referenced above, and not for the first time in
e-mail and print, Jason Aquilino misspelled Respondent's first name as
"Allan", and

2. In the same e-mail referenced above, and also not for the first
time, Jason Aquilino sent a copy of his message to a previously
misspelled e-mail address of webmaster@minnesotamenta.org.
